The Supreme Court has directed Matrimony.com and Jodi365 operator Free Elective Network to explore an out-of-court settlement in their five-year-old trademark infringement dispute. A bench comprising Justice PS Narasimha and Justice Alok Aradhe heard Matrimony.com's plea challenging a Madras High Court ruling that restrained it from using the ‘Jodii’ trademark for its matchmaking platform. Matrimony.com offered to rebrand its application as ‘Jodi Matrimony’ to avoid shutting down operations. The company argued that Free Elective lacks a Class 45 registration for matrimonial services and asserted that the term ‘Jodi’ cannot be monopolised.
